Accepting these terms
These terms are an agreement between you and WhyUpload ("we", "us"). By using whyupload.com you accept them. If you do not accept them, please do not use the site.
The service
WhyUpload is a set of file tools that run in your browser. They work with PDFs, images, and Office, text, CSV and HTML files, for example to convert, merge, edit, sign, compress and scan. The service is free and needs no account.
Acceptable use
Use the tools only with files you own or have the right to work with. Do not use WhyUpload for anything illegal, or to violate someone else's rights, privacy or confidentiality.
Use the password, unlock, redaction, sanitize and signing tools only when you are authorized to. WhyUpload does not give you any right to a document and does not check your authority. Do not try to disrupt the site or its servers, or send them automated or abusive traffic.
Your files and results
Your content stays yours. Your files are processed on your device and we do not receive them, so we claim no rights in them and cannot recover them for you.
You are responsible for keeping your originals and for checking every result before you rely on it or share it. Our Disclaimer explains the limits of each kind of tool and forms part of these terms.
Feedback
If you send us suggestions, we may use them to improve WhyUpload without owing you anything. How we handle what you send is covered in our Privacy Notice.
Our site and brand
The WhyUpload name, logo, site design and original content belong to us. These terms let you use the site, but they do not give you any rights in our name or brand.
Open-source components
WhyUpload includes open-source software, which is used under its own licenses. Those licenses, not these terms, govern that software. See the Open-Source Licenses page.
No warranty
WhyUpload is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, whether express or implied, including that the service will be uninterrupted or error-free, that results will be accurate, or that it will be fit for a particular purpose.
Limit of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost data, documents, profits or business, arising from your use of WhyUpload or from any result it produces. Our total liability for any claim is limited to the amount you paid us to use the service, if any.
Nothing in these terms limits a liability, or takes away a right, that the law where you live does not allow to be limited or excluded. If you are a consumer, you keep all the mandatory consumer rights that your own country gives you.
Changes and availability
We may change, pause or stop any part of WhyUpload at any time. We may also update these terms. When we do, we will post the new version here with a new effective date, and it applies from that date. If you keep using the site after that date, you accept the new terms.
Governing law
These terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable there. This does not take away any mandatory consumer protection that applies to you in your own country.
